SCRANTON, Pennsylvania – In a shocking turn of events, two inmates at the United States Penitentiary, Canaan, Waymart, Pennsylvania, have been charged with assault on another inmate using a homemade weapon.
According to federal authorities, Michael Caraballo, 34, and Victor Lopez, 28, allegedly assaulted another inmate in February 2017 with a sharpened piece of metal commonly known as a “shank.”
The indictment charges Caraballo and Lopez with assault with a dangerous weapon and aiding and abetting. Caraballo has also been charged with possessing contraband in prison.
The investigation into the incident was conducted by the Federal Bureau of Investigation and the Bureau of Prisons Special Investigative Service.
Assistant United States Attorney Robert J. O’Hara is responsible for prosecuting the case.
It is essential to note that indictments and criminal informations are only allegations. All persons charged are presumed to be innocent unless and until found guilty in court.
The maximum penalty under federal law for the offense is 10 years of imprisonment, a term of supervised release following imprisonment, and a fine. The exact sentence will be determined by the court after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.
