DALLAS, TX – A routine red light turned into a near-fatal ambush for an ATF agent in East Dallas this past April. Michael Fagan, 30, of Dallas, pleaded guilty Tuesday to one count of assaulting a federal officer using a deadly or dangerous weapon, admitting he fired at the agent during what authorities are calling a fit of road rage.
The incident unfolded at the intersection of Garland Road and Gaston Avenue on April 6th. The ATF agent, observing Fagan yelling and flailing inside his SUV, initially believed the driver was experiencing a medical emergency. Attempting to offer assistance, the agent lowered his window to inquire if Fagan was okay. That’s when the situation spiraled violently out of control.
According to court documents, Fagan abruptly opened his driver-side door and unleashed a tirade of incoherent yelling at the agent. After being instructed to re-enter his vehicle, Fagan instead leaned across the passenger seat, turning to face the agent while brandishing a black semiautomatic pistol. The agent, realizing the imminent threat, immediately ducked below the dashboard.
A single gunshot rang out. The agent, now under fire, returned fire, discharging three rounds and striking Fagan once before the suspect fled the scene. Fagan later sought medical attention at Baylor hospital, where he was subsequently arrested. The agent’s quick reaction undoubtedly prevented a more tragic outcome.
U.S. Attorney for the Northern District of Texas, Leigha Simonton, announced the guilty plea, a significant win for federal investigators. The Bureau of Alcohol, Tobacco, Firearms & Explosives’ Dallas Field Division, alongside the Dallas Police Department and the FBI’s Dallas Field Office, spearheaded the investigation. Assistant U.S. Attorney Robert Withers is prosecuting the case.
Fagan now faces a maximum sentence of 20 years in federal prison. While a sentencing date has not been set, this conviction sends a clear message: attacking a federal officer will be met with the full force of the law. The incident underscores the ever-present dangers faced by law enforcement, even during seemingly mundane encounters.
