On February 18, 2014, the United States Attorney’s Office in Vermont filed a federal indictment against Michael David Smith, a 32-year-old resident of Burlington, Vermont, in the United States District Court for the District of Vermont (VTD Federal District).
The indictment charged Smith with one count of being a felon in possession of a firearm, in violation of 18 U.S.C. § 922(g)(1), and one count of possession with intent to distribute 50 grams or more of a mixture and substance containing a detectable amount of heroin, in violation of 21 U.S.C. § 841(a)(1) and (b)(1)(B)(i).
According to court documents, on or about January 10, 2014, law enforcement officers executed a search warrant at a residence in Burlington, Vermont, where they found a loaded handgun and approximately 50 grams of heroin.
The case against Smith went to trial in October 2015. Following a three-day trial, the jury delivered a verdict of guilty on both counts.
On February 22, 2016, United States District Judge William K. Sessions III sentenced Smith to 120 months (10 years) in prison, followed by 3 years of supervised release. Smith was also ordered to pay a fine of $10,000 and a special assessment of $100.
