In a shocking turn of events, two inmates at the USP Canaan facility in Waymart, PA, have been charged with assaulting a fellow prisoner using a "shank" on June 4, 2016.
Miguel Grado, 26, and Rafael Torres-Villanueva, 43, are accused of committing the heinous crime, which has sparked a thorough investigation by the Federal Bureau of Investigation.
According to United States Attorney Peter Smith, Grado and Torres-Villanueva face charges for assaulting their victim with a dangerous weapon, a move that could see them imprisoned for a maximum sentence of up to ten years and a fine in the amount of $250,000.
The case is being led by Assistant United States Attorney Todd K. Hinkley, who is working tirelessly to ensure justice is served.
It’s worth noting that indictments and criminal informations are merely allegations, and all persons charged are presumed innocent until proven guilty in a court of law.
The maximum penalty under federal law for this offense is 10 years of imprisonment, a term of supervised release following imprisonment, and a fine. However, the actual sentence will depend on various factors, including the nature and circumstances of the crime, the defendant’s history and characteristics, and the need to punish the defendant, protect the public, and provide for the defendant’s educational, vocational, and medical needs.
