GRAND RAPIDS, MICHIGAN – Benjamin Franklin Miklusicak, 41, of Dorr, Michigan, is headed back to prison after being sentenced to 124 months for possessing horrific images of child pornography. The sentence, handed down by U.S. District Judge Janet T. Neff, reflects the gravity of his crime and his prior conviction, a damning pattern of predatory behavior.

Acting U.S. Attorney Andrew Byerly Birge announced the sentencing today, detailing how Miklusicak pleaded guilty in December to the charge. The 124-month term wasn’t just based on the current offense; a 2004 conviction for criminal sexual conduct, second degree (person under thirteen), triggered a mandatory minimum of ten years imprisonment. This wasn’t a first offense, it was a continuation of a disturbing history.

Investigators uncovered a chilling admission from Miklusicak himself: a confessed sexual interest in girls between the ages of nine and thirteen, coupled with a weekly habit of consuming child pornography. The images recovered from his laptop weren’t benign; they depicted prepubescent children engaged in sexual acts, a sickening testament to his depravity. This wasn’t about curiosity; it was active participation in the exploitation of vulnerable victims.

“There is perhaps no better indicator of the impending danger posed by a known pedophile than his decision to seek out images of children being abused,” Birge stated bluntly. “Incapacitation of recidivist sex offenders is critical to the protection of the kids in our community.” The message is clear: repeat offenders will face the full force of the law, and the priority is safeguarding children.

Steve Francis, Acting Special Agent in Charge of Homeland Security Investigations (HSI) Detroit, echoed that sentiment. “Miklusicak’s repeat sexual offenses make him an extreme danger to our youth. This sentencing will ensure that he no longer has access to children in any way,” Francis said. The investigation was spearheaded by HSI, with Assistant U.S. Attorney Justin M. Presant leading the prosecution.
