Amherst Man Guilty of Child Porn Possession
A 52-year-old Amherst man has pleaded guilty to possession of child pornography, a crime that carries a minimum penalty of 10 years, a maximum of 20 years, and a $250,000 fine.
Gary Todd Baker was arrested on May 28, 2020, after Erie County Probation Officers conducting a routine check discovered he was in possession of an internet-capable cellular device and hundreds of images of child pornography.
On March 4, 2020, Baker was convicted in Erie County Court of possession of a sexual performance by a child under the age of 16, a crime that led to his designation as a level-2 sex offender and a 10-year probation sentence.
Just eight days into his probation term, probation officers discovered evidence of child pornography, including a bag of torn-up printed images, which were later reassembled by the FBI’s Child Exploitation Task Force to confirm they depicted child pornography.
The investigation was led by the Federal Bureau of Investigation’s Child Exploitation Task Force, under the direction of Special Agent-in-Charge Stephen Belongia, the Erie County Probation Department, under the direction of Commissioner Brian McLaughlin, and the Town of Tonawanda Police Department, under the direction of Chief James P. Stauffiger.
Baker’s plea is the result of a joint investigation that uncovered his possession of hundreds of images of child pornography. Sentencing is scheduled for January 13, 2022, before U.S. District Judge John L. Sinatra, Jr.
