Assault Charges Filed Against Mission Man
Francisco Maldonado, a 40-year-old man from Mission, South Dakota, has been indicted by a federal grand jury for Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury.
According to reports, Maldonado was arraigned before U.S. Magistrate Judge Mark A. Moreno on June 19, 2013, and entered a not guilty plea to the charges.
The maximum penalty for conviction is up to 10 years in custody, a $250,000 fine, or both; life of supervised release; and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The investigation into the assault is being conducted by the Federal Bureau of Investigation and the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Marie H. Ruettgers is handling the prosecution of the case.
Maldonado was remanded to the custody of the U.S. Marshals pending trial, with a trial date set for August 13, 2013. The charge is merely an accusation, and Maldonado is presumed innocent until proven guilty.
The severe nature of the charges underscores the gravity of the alleged assault. Assault with a Dangerous Weapon carries significant penalties, and the fact that the victim suffered serious bodily injury adds to the severity of the charges.
