Johnny Lunderman, Failure to Register as a Sex Offender, South Dakota 2013

A 30-year-old Mission, South Dakota man has been sentenced for failing to register as a sex offender.

Johnny Lunderman, also known as Johnny Iron Horse, was sentenced to 16 months in custody, 5 years of supervised release, and $100 to the Federal Crime Victims Fund by U.S. District Judge Roberto A. Lange on June 3, 2013. This sentence stems from his conviction of Failure to Register as a Sex Offender.

The investigation revealed that Lunderman, who was convicted of Sexual Abuse of a Minor on September 8, 2009, was not living at the home where he was registered in Rapid City. It was determined that he was not complying with the terms of his supervised release after beginning his term on January 9, 2012.

The U.S. Marshal Services conducted the investigation and Assistant U.S. Attorney Tim Maher prosecuted the case. Lunderman was arrested on February 3, 2013, near the Rosebud Sioux Indian Reservation after a federal grand jury indicted him on February 13, 2013. He pleaded guilty to the charge on March 19, 2013.

Lunderman’s past convictions and supervised release terms required him to register as a sex offender. His failure to do so resulted in his imprisonment and additional supervised release.

The U.S. Attorney’s Office for the District of South Dakota announced the sentencing. The case highlights the importance of sex offender registration and compliance with the terms of supervised release.

The U.S. Marshal remanded Lunderman to custody following the sentencing.
