A heated debate is unfolding in the halls of justice over the collection of mortgage tax in Arkansas. At the center of the controversy is the decision of the sheriff of Tulla Ki County to take the mortgage tax dispute to court. The sheriff is pushing to force the payment of mortgage tax, but a prominent Little Rock attorney representing foreign capital with large loans in the state is countering with a stern warning: ‘You cannot collect the tax from non-resident mortgagees,’ he says. ‘The supreme court of the United States has settled that the situs of the debt is where the creditor lives, and the mortgage debt must be assessed there.’
