Muskogee Man Sentenced to 30 Months for Firearm Possession
A Muskogee man has been handed a 30-month prison sentence for his part in a firearm possession case. Charles Ray Benefield, 32, was sentenced on [unspecified date] in the United States District Court for the Eastern District of Oklahoma.
Benefield was found guilty of being a felon in possession of a firearm, according to prosecutors. He had previously been convicted of a crime punishable by a sentence exceeding one year, making him ineligible to possess a firearm.
The charges against Benefield stem from an investigation by the United States Marshals Service, the Eastern Oklahoma Violent Crimes Fugitive Task Force, and the Federal Bureau of Investigation. The defendant was indicted in March 2016.
The indictment alleged that on or about December 30, 2015, Benefield knowingly possessed a firearm that had been shipped and transported in interstate commerce. The firearm’s movement across state lines is a key element of the federal crime.
Bennfield will remain in the custody of the United States Marshals Service until he is transported to a federal facility to serve his sentence. His imprisonment is non-parolable, meaning he will not be eligible for early release.
Assistant United States Attorney Tim Hammer represented the United States in the case. The Honorable Ronald A. White presided over the hearing. The sentence is the result of a multi-agency effort to combat firearm possession by felons.
