Nampa Man Pleads Guilty to Unlawfully Possessing Firearm
BOISE – In a shocking turn of events, a Nampa man has pleaded guilty to unlawfully possessing firearms while under a protective order. Darrel Dwayne Smith, 44, of Nampa, Idaho, faced a judge in United States District Court and admitted to the charges.
According to the plea agreement, on June 16, 2013, Smith was arrested for misdemeanor DUI, possession of marijuana, and possession of drug paraphernalia. In the bed of the pickup truck he was driving, Smith had a loaded Ruger .44 caliber revolver, ammunition, and a Smith and Wesson .22 caliber revolver. At the time of his arrest, Smith was under a protective order issued in Canyon County, Idaho, on January 24, 2013, and valid until July 31, 2013.
The protective order prohibited Smith from harassing, annoying, disturbing the peace of, contacting, or otherwise communicating with his wife. Smith’s actions directly disregarded the order, putting his wife and others at risk. His possession of firearms while under the order is a serious offense, and he will face the consequences.
Smith agreed to forfeit the firearms and ammunition as part of the plea agreement. He is set to be sentenced on January 24, 2014, before Chief U.S. District Judge B. Lynn Winmill at the federal courthouse in Boise.
The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and is part of Idaho’s Project Safe Neighborhoods Program. This program aims to reduce gun violence in Idaho by cracking down on individuals who possess firearms illegally.
U.S. Attorney Wendy J. Olson announced Smith’s guilty plea and praised the efforts of the ATF and Project Safe Neighborhoods Program. ‘We take the possession of firearms by individuals under protective orders very seriously, and we will continue to work to keep our communities safe,’ Olson said.
With Smith’s guilty plea, he faces the possibility of serious consequences, including imprisonment and fines. His actions demonstrate a blatant disregard for the law and put his wife and others at risk. The community can breathe a sigh of relief knowing that Smith will face justice for his crimes.
