Napoleon Tabot, Lovet Ayuk-Ako Sentenced for Tax Fraud, Miami FL, 2023
A pair of tax preparers have been sentenced to federal prison for their involvement in a scheme to file false tax returns in Miami, Florida.
Napoleon Tabot, 60, of Chandler, Ariz., and Lovet Ayuk-Ako, 40, of Silver Spring, Md., were handed down prison sentences by U.S. District Judge Roy K. Altman. Tabot received 18 months in federal prison, while Ayuk-Ako was sentenced to 30 months in federal prison for their conviction on conspiracy to commit tax fraud.
According to court documents, Tabot recruited clients for Ayuk-Ako’s tax preparation business, Money Back Tax, LLC, located in Maryland. The business had clients in Florida, Maryland, and Washington, D.C. After collecting personal identifying information and tax data from his clients, Tabot would provide it to Ayuk-Ako and co-conspirator Arnold Zio for tax return preparation. Ayuk-Ako and Zio then filed and caused to be filed false tax returns that claimed inflated refunds, directing all or part of the refunds to be deposited into bank accounts under their control without the taxpayer’s knowledge or consent.
The scheme resulted in a tax loss of more than $500,000 to the United States. Co-conspirator Zio remains a fugitive, with all defendants presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
U.S. Attorney Markenzy Lapointe for the Southern District of Florida and Special Agent in Charge Matthew D. Line of the IRS Criminal Investigation (IRS-CI) Miami Field Office announced the sentences imposed. IRS-CI Miami investigated the case, with Assistant U.S. Attorney Marc Anton prosecuting it.
