Nicholas Stanley, a 40-year-old Dalton, Pennsylvania resident and owner of Nick Stanley Paving, Inc., is facing serious charges in a tax evasion scandal. According to the United States Attorney’s Office for the Middle District of Pennsylvania, Stanley was indicted on April 2, 2019, for tax evasion and structuring transactions to evade a reporting requirement.
Stanley allegedly took affirmative steps to evade the payment of taxes while owing a staggering $1,062,312.10 for tax years 2005 to 2011. The Internal Revenue Service, Criminal Investigation Division, played a crucial role in investigating this case.
The indictment against Stanley marks a significant turning point in this investigation. The case is being prosecuted by Assistant U.S. Attorney Alisan V. Martin.
It is essential to note that criminal indictments are only allegations, and all persons charged are presumed innocent until found guilty in court. A sentence following a finding of guilt is imposed by the Judge after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.
The maximum penalty under federal law for each offense charged is five years of imprisonment, a term of supervised release following imprisonment, and a fine. Under the Federal Sentencing Guidelines, the Judge is also required to consider and weigh a number of factors, including the nature, circumstances, and seriousness of the offense; the history and characteristics of the defendant; and the need to punish the defendant, protect the public, and provide for the defendant’s educational, vocational, and medical needs.
The United States Attorney’s Office for the Middle District of Pennsylvania has handled this case with the utmost care and attention to detail. The public can expect a thorough and fair investigation, and the outcome will be determined by the courts.
