Nikita Burt, Conspiracy to Distribute Crack Cocaine, New York 2022

Nikita Burt, a 39-year-old Buffalo man, is headed to prison after being convicted of conspiracy to possess with intent to distribute crack cocaine. According to court documents, Burt supplied crack cocaine to a co-defendant who then sold it to an undercover DEA agent.

Between October 2021 and January 12, 2022, Burt allegedly provided the crack cocaine to David Garrett, who made three controlled purchases of the substance from Burt’s supplier.

The DEA conducted three controlled purchases of cocaine from Garrett between November and December 2021. On January 12, 2022, agents executed search warrants on Burt’s vehicle and his Mortimer Street residence, where they recovered $2,334 in cash and three defaced handguns.

One of the handguns was linked to Burt through DNA analysis. Burt’s sentencing is the result of an investigation by the Drug Enforcement Administration, the Buffalo Police Department, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives.

U.S. Attorney Trini E. Ross announced the sentencing, which was handed down by U.S. District Judge Lawrence J. Vilardo. Assistant U.S. Attorney Timothy C. Lynch handled the case.

Burt’s prison sentence is a result of his involvement in the crack cocaine conspiracy. The investigation was led by the DEA, under the direction of Special Agent-in-Charge Frank A. Tarentino III, the Buffalo Police Department, under the direction of Commissioner Joseph Gramaglia, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives, under the direction of Special Agent-in-Charge John B. Devito.
