FRISCO, CO – A Frisco hotel owner and several contractors faced state charges after a 2009 renovation at the Holiday Inn, located at 1129 North Summit Boulevard, exposed workers and guests to dangerous asbestos levels. The case, prosecuted by the Colorado Department of Public Health and Environment, revealed a pattern of negligence and alleged deliberate endangerment, culminating in guilty pleas and substantial financial penalties.
The initial violation occurred in October 2009 when renovations began without the required permits for asbestos abatement. Asbestos, a known carcinogen, was disturbed during the process, contaminating multiple rooms within the hotel. The Colorado Department of Public Health and Environment swiftly intervened, ordering the hotel owner to cease renting out the affected rooms to prevent further exposure. However, investigators allege that the owner, Nikolai Semenshin, disregarded this directive.
According to the indictment, Semenshin allegedly instructed housekeeping staff to clean the contaminated rooms, knowingly exposing them to the hazardous substance. More disturbingly, authorities suspect that Semenshin continued to rent these same rooms to unsuspecting guests, potentially putting dozens of individuals at risk of developing asbestos-related illnesses years down the line. Legal Ramifications & Plea Deals
On April 20, 2011, Semenshin, along with Gora, Para, and construction firm NVH Construction, were formally charged with three counts of violating Colorado state environmental regulations. These included causing and contributing to a hazardous substance incident, a violation of C.R.S. 29-22-108, and violations of the Air Quality Control Act – specifically, knowing endangerment under C.R.S. 25-7-122.1(3)(a). New Vision, another contracting company involved, was subsequently charged with two similar counts.
The legal proceedings unfolded with a series of guilty pleas. New Vision pled guilty to both counts levied against them. Shortly after, on October 3, 2011, Semenshin and NVH Construction also entered guilty pleas to all three charges. Semenshin received a $500 state fine and was ordered to pay $156 in restitution. NVH Construction faced a significantly larger financial penalty, being sentenced to pay $30,156 in restitution. New Vision was also sentenced to pay restitution, totaling $50,326. Gora and Para later pled guilty to one count of C.R.S. 29-22-108(1) on March 19, 2012, receiving a deferred sentence of 12 months probation and joint and several restitution of $1,218.71.
