New York – In a bold move that mirrors the state’s progressive stance on reproductive rights, New York Attorney General Letitia James has joined forces with attorneys general from California, Massachusetts, and New Jersey to demand the U.S. Food and Drug Administration (FDA) dismantle outdated restrictions on mifepristone, an abortion medication.
Attorney General James and her coalition argue that the drug’s 25-year safety record makes it unnecessary to impose the current Risk Evaluation and Mitigation Strategy (REMS) program, which they say hampers access to medication abortion without enhancing patient safety. The petition arrives as the FDA reviews mifepristone labeling requirements under the direction of Secretary of Health and Human Services Robert F. Kennedy, Jr.
Mifepristone, when used with misoprostol, is the leading method for early pregnancy termination in the U.S. Since its approval in 2000, over 7.5 million people have safely utilized the drug. Despite its proven safety and effectiveness, mifepristone remains bound by a REMS program originally designed for drugs with serious risks, imposing prescriber certification, patient agreement forms, and pharmacy certification.
Attorney General James asserts that these requirements are arbitrary and hinder access to care, particularly in rural and underserved areas. She points out that the administrative burden of REMS has kept mifepristone out of most primary care settings, limiting medication abortions to specialized facilities and contributing to the lack of abortion providers across the U.S.
“Given mifepristone’s 25-year safety record, there is no scientific or medical rationale for these restrictions,” said Attorney General James. “New Yorkers and all Americans deserve unfettered access to this safe medication without unjustified hurdles.”
The coalition hopes the FDA will use this opportunity to remove these barriers and ensure wider availability of mifepristone, reflecting a commitment to following science and protecting patient health.
