New York Attorney General Letitia James and a coalition of 20 states have filed a lawsuit against a federal regulation aimed at dismantling Affordable Care Act (ACA) protections. The rule, which targets millions of Americans’ health care coverage, is set to take effect in August 2025.
Attorney General James and her allies claim the U.S. Department of Health and Human Services (HHS) and Centers for Medicare and Medicaid Services (CMS) have overstepped their authority with this illegal rollback. They argue that the rule violates federal law, disregards expert advice, and imposes undue burdens on state health systems.
The ACA, enacted in 2010, aimed to expand access to affordable insurance and reduce costs for individuals and families. It created health insurance marketplaces and required plans to cover essential health benefits. Over the past five years, annual enrollment under the ACA has doubled, with over 24 million Americans signed up this year alone.
The new rule reduces open enrollment windows, eliminates year-round enrollment for low-income individuals, adds extensive paperwork and verification requirements, makes it harder to access tax credits, and limits automatic reenrollment. It also imposes illegal monthly charges on zero-dollar premium plan consumers. These changes are seen as directly undermining the ACA’s mission of expanding affordable health care access.
In addition, the rule bans states from including gender-affirming care in the essential health benefits list under the ACA. This discriminatory policy will exclude coverage for treatments related to gender dysphoria, while allowing similar treatments for other conditions. The attorneys general argue this discriminates against transgender individuals and conflicts with state laws that prohibit healthcare discrimination based on gender identity.
Attorney General James emphasizes the gravity of the situation, stating, “This new rule is an illegal and dangerous attack on health care access. It strips working families of their coverage, imposes unnecessary red tape, and deliberately targets low-income and transgender Americans.”
