Octaviano Boche, Illegal Reentry, Massachusetts 2023

Three men have been charged with illegally reentering the United States after being deported, according to a federal indictment unsealed yesterday in Boston.

The defendants are Octaviano Boche, 48, a Guatemalan national; Daniel Brandes-Muniz, 35, a Brazilian national; and Jose Urena Vasquez, 42, a Dominican national.

According to the indictment, Boche was previously deported on April 27, 2016, but was encountered by law enforcement in Billerica on September 7, 2018, and found to be unlawfully present in the US. He is currently in state custody awaiting trial on unrelated charges.

Brandes-Muniz, who was previously deported on March 22, 2004, was encountered by law enforcement in Billerica on April 28, 2018, and found to be unlawfully present in the US. He is currently in state custody serving a sentence on unrelated charges.

Urena Vasquez, who was previously deported on March 25, 2009, was encountered by law enforcement in Middleton on September 13, 2018, and found to be unlawfully present in the US. He is currently in state custody awaiting trial on unrelated charges.

The indictment charges each man with one count of illegal reentry of a deported alien. If convicted, Boche faces up to two years in prison, one year of supervised release, and a fine of $250,000. Brandes-Muniz faces up to 10 years in prison, three years of supervised release, and a fine of up to $250,000. Urena Vasquez faces up to 20 years in prison, three years of supervised release, and a fine of up to $250,000.

All three defendants will be subject to deportation upon completion of any sentences imposed.

The indictment is the result of an investigation by U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations. Assistant U.S. Attorney Kenneth G. Shine of U.S. Attorney Andrew E. Lelling’s Major Crimes Unit is prosecuting the case.
