Oscar F. Hernandez III, Child Pornography, New York 2025

Oscar F. Hernandez III, a 24-year-old Buffalo man, was sentence to 10 years in prison and 10 years supervised release for a child pornography charge, according to the U.S. Attorney’s Office for the Western District of New York.

The sentencing comes after Hernandez, who was previously convicted of possession of child pornography involving a prepubescent minor, used Instagram to share two child pornography videos with another user in June 2024.

Assistant U.S. Attorney Douglas A.C. Penrose stated that Hernandez’s actions were a clear violation of the law and showed a blatant disregard for the safety and well-being of children.

On May 14, 2025, a search warrant was executed at Hernandez’s residence, during which law enforcement seized a number of electronic devices, including a cellular telephone, which contained 15 images of child pornography.

The sentencing of Hernandez was the result of an investigation by Homeland Security Investigations, under the direction of Special Agent-in-Charge Erin Keegan and the National Center for Missing and Exploited Children.

U.S. District Judge John L. Sinatra, Jr. handed down the sentence, which includes 10 years in prison and 10 years of supervised release for Oscar F. Hernandez III.

Hernandez’s prior conviction under New York law relating to possession of child pornography was also taken into consideration during the sentencing.

The case serves as a reminder of the importance of holding individuals accountable for their actions, particularly when it comes to the exploitation and abuse of children.
