A 45-year-old Argentinian man has been indicted for violating U.S. immigration laws by illegally entering the country.
Pablo Guzobad-Mendoza was found to be in Ohio on July 9, 2016, after having been deported from the United States on a previous occasion.
Guzobad-Mendoza had previously been convicted of illegal entry into the United States in federal court in Texas and burglary with assault or battery in Miami-Dade County, Florida, according to the indictment.
The defendant is currently serving a term of imprisonment in an Ohio prison on unrelated charges.
The investigation was conducted by the Immigration and Customs Enforcement Agency in conjunction with the Strongsville Police Department. The case is being prosecuted by Assistant United States Attorney Kevin R. Filiatraut.
If convicted, the defendant’s sentence will be determined by the court after review of factors unique to this case, including the defendant’s prior criminal record, if any, the defendant’s role in the offense, and the characteristics of the violation. In all cases, the sentence will not exceed the statutory maximum, and in most cases it will be less than the maximum.
An indictment is only a charge and is not evidence of guilt. A defendant is entitled to a fair trial, in which it will be the government’s burden to prove guilt beyond a reasonable doubt.
