Perry T. Johnson, Escape, Ohio 2013

A brazen escape from the Bedford Heights Jail has landed a Cleveland man in hot water. Perry T. Johnson, age 22, was charged with escape after making a break for it on August 12, 2013.

Johnson was being held at the jail pending sentencing in a separate case, where he had pleaded guilty to two counts of robbery, including brandishing a firearm during one of the heists. He also admitted to possessing oxycodone with intent to distribute, which he stole from a CVS pharmacy.

The robberies took place in November 2012, and Johnson is scheduled to be sentenced on August 20, 2013.

According to the indictment, Johnson escaped from the jail despite being ordered detained by U.S. Magistrate Judge Kenneth S. McHargh. If convicted, Johnson’s sentence will be determined by the court after reviewing factors unique to the case, including his prior criminal record, his role in the offense, and the characteristics of the violation.

The maximum sentence will not exceed the statutory maximum, and in most cases, it will be less than the maximum.

An indictment is only a charge and is not evidence of guilt. Johnson is entitled to a fair trial, where the government will have to prove his guilt beyond a reasonable doubt.

The case is being prosecuted by Assistant U.S. Attorneys Matthew B. Kall and Margaret A. Sweeney, following an investigation by the U.S. Marshal Service and the Bedford Heights Police Department.

Perry T. Johnson, a resident of Cleveland, Ohio, is currently facing charges of escape from the Bedford Heights Jail. The exact sentence for this crime is yet to be determined.

Johnson’s prior case, where he pleaded guilty to robbery and possessing oxycodone with intent to distribute, is scheduled to be sentenced on August 20, 2013.
