Randy Daniel Shattuck Sentenced to 21 Months for Destroying Evidence
A 29-year-old man from San Jose, California, has been sentenced to 21 months in prison for intentionally destroying evidence, according to a recent announcement from United States Attorney Melinda Haag.
Randy Daniel Shattuck was sentenced on September 5, 2013, after pleading guilty to a single count of destroying evidence. The crime was uncovered during an investigation into his internet activities, which prompted federal agents to arrive at his residence.
Shattuck admitted to intentionally destroying files stored on his external hard drive just minutes before the agents arrived, in an attempt to obstruct the investigation. He was indicted by a federal grand jury on September 26, 2012, and charged with a single count of destroying evidence under 18 U.S.C. 1519.
According to the plea agreement, Shattuck accepted responsibility for his actions and agreed to the sentence. The Honorable D. Lowell Jensen, U.S. Senior District Court Judge, handed down the sentence, which also included a fine of $3,000 and three years of supervised release. The defendant will begin serving the sentence on November 5, 2013.
This conviction serves as a reminder of the consequences of attempting to destroy evidence, said United States Attorney Melinda Haag. The sentence should send a strong message of deterrence to anyone considering similar actions.
The prosecution was led by Assistant United States Attorney Timothy J. Lucey, with the assistance of Laurie Worthen. The investigation was conducted by the Homeland Security Investigations, Department of Homeland Security.
