Randy Kirby, 61, of Hastings, Nebraska, Sentenced for Health Care Fraud
A former mental health therapist in Hastings has been sentenced for his role in a health care fraud scheme that spanned three years. Randy Kirby, 61, was sentenced to a year and a day in federal prison and ordered to pay restitution of more than $130,000.
According to the investigation, Kirby submitted false claims for reimbursement to Nebraska Medicaid for services that he could not show had occurred. The claims were submitted between September 2013 and September 2016, during which time he received $133,639.57 in payments from the state.
The scheme came to light after a referral by Medicaid contractor Magellan Behavioral Health, which had become concerned about suspicious billings submitted by Kirby. The matter was investigated by the Program Integrity Unit of Nebraska Medicaid and the Medicaid Fraud and Patient Abuse Unit of the Nebraska Attorney General’s Office.
Kirby’s sentence was handed down by Senior U.S. District Judge Richard Kopf in Lincoln on January 17, 2019. He will be on supervised release for three years following his prison term. The charges against Kirby included nine counts of Health Care Fraud, but he pleaded guilty to one count in October 2018.
The case serves as a reminder of the importance of vigilance in the health care system. Medicaid contractor Magellan Behavioral Health took proactive steps to identify suspicious activity, which ultimately led to the exposure of Kirby’s scheme.
