RAPID CITY, SD – Eugene Leon Featherman, 30, of Rapid City, is facing federal charges for allegedly failing to comply with sex offender registration requirements, according to a statement released by U.S. Attorney Ron Parsons. The indictment, handed down by a federal grand jury on November 14, 2018, alleges Featherman deliberately skirted the law meant to keep communities safe.
Featherman was initially convicted of Abusive Sexual Contact in January 2012. This conviction triggered a mandatory 25-year sex offender registration requirement. Federal prosecutors claim that between August 25, 2018, and November 14, 2018, Featherman failed to properly register as required under the Sex Offender Registration and Notification Act (SORNA) and federal law. The U.S. Marshals Service is leading the investigation into the alleged violations.
The defendant appeared before U.S. Magistrate Judge Mark A. Moreno on May 31, 2019, and entered a plea of not guilty to the indictment. Despite the charges, Featherman is presumed innocent until proven guilty in a court of law. The government bears the burden of proof, and Featherman has the right to a vigorous defense.
If convicted, Featherman could face a harsh penalty: up to 10 years in federal prison, and/or a fine of up to $250,000. The sentencing doesn’t stop there; a conviction could also lead to 5 years of supervised release following incarceration, as well as a $100 contribution to the Federal Crime Victims Fund. Restitution may also be ordered by the court.
Following the arraignment, Featherman was remanded to the custody of the U.S. Marshals Service to await trial. No trial date has been set at this time. The case is being prosecuted by Assistant U.S. Attorney Michael J. Elmore, who will present the evidence against Featherman.
