LAS VEGAS, NV – David Cristales-Machado, a Salvadoran national with a history of run-ins with the law, is headed back to prison. Chief United States District Judge Andrew Gordan handed down a 15-month sentence today, followed by three years of supervised release, for the simple fact of being back where he wasn’t supposed to be: the United States.
The case against Cristales-Machado unfolded after multiple encounters with law enforcement in Clark County, Nevada. He was initially found by immigration officials following arrests and convictions for carrying a concealed weapon without a permit – first in October 2024, and again in January 2025. This wasn’t his first rodeo with the American justice system, or deportation for that matter.
Court records reveal a checkered past. Cristales-Machado was first deported to El Salvador in 2014 after serving time for three separate felony convictions. He’d previously been found guilty of two counts of attempt possession of a stolen vehicle and one count of attempt burglary. Clearly, a previous stint in a US prison – and expulsion from the country – wasn’t enough to keep him from returning.
He pleaded guilty to one count of Deported Alien Found in the United States, a charge that carries significant penalties, particularly for those with prior convictions. This isn’t simply about border security; it’s about a pattern of disregard for the law and a continued threat to public safety, according to federal prosecutors.
Acting United States Attorney Sigal Chattah for the District of Nevada and Salt Lake City Acting Field Office Director Jason Knight announced the sentencing, emphasizing the commitment of federal agencies to enforce immigration laws and remove individuals who pose a risk. After completing his 15-month sentence, Cristales-Machado will once again be deported to El Salvador, though authorities acknowledge the possibility of future attempts to re-enter the country.
The investigation was spearheaded by ICE’s Salt Lake City field office, Las Vegas Sub-Office, with prosecution handled by the United States Attorney’s Office for the District of Nevada.
