Rey Daniel Facio-Garcia, Firearm and Immigration Offenses, Florida 2021

A violent crime unfolded in Ocala, Florida, on September 4, 2021, when Rey Daniel Facio-Garcia, 27, a Mexican national, was accused of brandishing a firearm and firing a shot in a residence’s kitchen. Facio-Garcia, who had previously been deported from the United States in 2014 and 2015, allegedly fled from officers but was quickly apprehended.

According to court documents, the officers located a .45 caliber handgun in the vehicle under the driver’s seat and a .45 caliber shell casing inside the kitchen of the residence. Facio-Garcia, who never had received permission to lawfully return to the United States, faces a combined penalty of up to 12 years in federal prison on the offenses.

This case was investigated by Homeland Security Investigations, the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Leesburg Police Department. It is being prosecuted by Assistant United States Attorney William S. Hamilton.

Facio-Garcia pleaded guilty to two indictments— one charging him with possession of a firearm affecting commerce by an illegal alien and another charging him with illegal re-entry into the United States after a previous deportation. A sentencing date has not yet been scheduled.

As part of the guilty plea, Facio-Garcia acknowledges that he is a Mexican citizen who previously has been deported from the United States in 2014 and 2015. He never had received permission to lawfully return to the United States.

PSN launched a violent crime reduction strategy strengthening the program based on core principles.
