Tax Evasion Lands New Jersey Attorney in Hot Water

NEWARK, N.J. – Richard Roberts, a 79-year-old suspended Essex County lawyer, has admitted to failing to pay payroll and personal income taxes, according to a grim revelation from the U.S. Attorney’s Office.

Roberts, a sole owner of a law office in Newark, pleaded guilty to one count of failing to pay payroll taxes and one count of failing to pay personal income taxes before U.S. District Judge Esther Salas in Newark federal Court.

According to documents filed in the case, Roberts was required to deduct and withhold federal income and insurance taxes from his employees’ wages and file quarterly forms with the IRS. However, he failed to make any payroll tax payments to the IRS for 12 quarters spanning from 2009 to 2011.

Roberts also failed to pay personal income taxes since at least 2000, with a tax return filed in 2012 listing an unpaid balance of $20,361 for the tax year 2010. The total amount of unpaid taxes is unknown.

The count of failure to pay payroll taxes carries a maximum potential penalty of five years in prison and a fine of the greater of $250,000, twice the gross profits to Roberts, or twice the gross loss to the victim. The count of failure to pay income taxes carries a maximum potential penalty of one year in prison and a fine of the greater of $100,000, twice the gross profits to Roberts, or twice the gross loss to the victim.

Roberts is scheduled to be sentenced on August 1, 2017. He is represented by Lisa Mack, Esq., Assistant Federal Public Defender. The government is represented by Assistant U.S. Attorney Andrew Kogan of the U.S. Attorney’s Office Economic Crimes Unit.
