In a stunning display of disregard for the law, a previously convicted Albuquerque man has been charged with being a felon in possession of a firearm and ammunition.
Robert Maestas, 48, of Albuquerque, was taken into custody on October 7, 2023, after a detention hearing in federal court. He is currently being held without bail pending trial.
According to a criminal complaint filed against Maestas, on September 3, 2023, he allegedly shot at the home of his former girlfriend, prompting a search of his residence and vehicle. During the search, authorities discovered a pistol and ammunition in Maestas’ possession.
As a previously convicted felon, Maestas is prohibited from possessing a firearm or ammunition, making his alleged actions a serious offense. If convicted, he faces up to 10 years in prison.
The investigation into Maestas’ activities was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Albuquerque Police Department. Assistant U.S. Attorney Presiliano Torres is handling the prosecution.
It is worth noting that an indictment is merely an allegation, and Maestas is presumed innocent until proven guilty in a court of law.
