MIAMI, FL – January 27, 2025 – Roberto Pulido, also known as Berto Delvanicci, has been slapped with a default final judgement by the Southern District of Florida for perpetrating a forex fraud scheme, the Commodity Futures Trading Commission (CFTC) announced today. The judgment also encompasses Pulido’s company, Lions of Forex LLC, both based in Miami, Florida.
The CFTC initially filed a complaint against Pulido on September 28, 2023, alleging that he fraudulently solicited at least four clients into trading leveraged off-exchange foreign currency (forex). LOF was accused of aiding and abetting the scheme.
The court orders mandate that Pulido and LOF, jointly and severally, pay approximately $172,000 in restitution to the victims of the fraud and over $516,000 in civil monetary penalties. Additionally, both defendants are permanently prohibited from violating the Commodity Exchange Act, registering with the CFTC, or trading on CFTC-regulated markets.
According to the orders, filed November 13, 2024, from January 2019 to March 2021, Pulido, with the assistance of LOF, misled clients into investing in leveraged forex trading. LOF offered a retail forex signals service, charging monthly fees for trading signals and premium one-on-one training with Pulido himself. The company’s website promoted Pulido as a “seven-figure trader,” and he further boasted of significant profits on social media.
Pulido allegedly guaranteed monthly profits and easy fund withdrawals to prospective clients, promises he failed to deliver on. Clients were unable to access significant portions of their invested funds when they requested them. LOF facilitated the fraud by receiving client funds into its bank accounts, allowing Pulido to use those accounts, promoting his supposed expertise, and utilizing LOF’s email to communicate with defrauded clients.
The CFTC acknowledged the assistance provided by the Florida Office of Financial Regulation, the Eastern Caribbean Securities Regulatory Commission, and the Financial Services Authority of St. Vincent & the Grenadines in the investigation.
The case was led by CFTC staff members Elizabeth C. Brennan, David MacGregor, Lenel Hickson, Manal S. Sultan, and former staff member Steven I. Ringer.
