Marcos D. Guzman, Burglary of Federal Firearms Licensee, New York 2018

ROCHESTER, N.Y. – The gritty streets of Rochester saw a pivotal moment as Marcos D. Guzman, 35, pleaded guilty in federal court for his role in the brazen August 2018 burglary of Chinappi’s Firearms & Supplies. The crime, which saw nearly 90 firearms stolen, shook the local community and led to an intensive investigation.

U.S. Attorney James P. Kennedy, Jr., announced that Guzman admitted to the theft of firearms from a federal firearms licensee and possession of firearms by a convicted felon. He now faces up to ten years in prison and a quarter-million-dollar fine for his actions.

The heist was executed with chilling precision. Guzman, along with co-defendants Dakota Sarfaty and Luis D. Marcano-Agosto, broke into the gun store early on August 16, 2018. They managed to make off with an arsenal of approximately 87 firearms, almost all handguns. The trio then set about selling their ill-gotten goods on the streets of Rochester.

According to the plea agreement, law enforcement was swift in response, recovering 14 of the stolen firearms just a day after the theft. Guzman’s sentencing is set for July 29, 2019, at 2:00 p.m., before U.S. District Judge Elizabeth A. Wolford.

The investigation was led by the Bureau of Alcohol, Tobacco, Firearms & Explosives (ATF), the Monroe County Sheriff’s Office, and the Rochester Police Department. Special Agent-in-Charge Ashan Benedict of the ATF New York Field Division directed the ATF’s involvement.

Assistant U.S. Attorney Brett A. Harvey is handling the case for the government, ensuring that justice is served for this flagrant disregard for law and order.
