Rochester Man Gets Probation for False Immigration Claim

A 41-year-old man from Yemen has been sentenced to a year of probation for making false statements on a naturalization application.

Tuffek Mohammed Ali Saleh was convicted of making a false statement on an immigration document, in a case handled by Assistant U.S. Attorney Craig R. Gestring.

Saleh, who applied for U.S. Citizenship under the name Yehya Muthana Ali in April 2012, was found to have previously used a different identity to try to enter the United States.

During an immigration interview in April 2012, Saleh repeatedly denied ever using another name to try to enter the country.

The investigation into Saleh’s false statements was conducted by Immigration and Customs Enforcement, Homeland Security Investigations, the New York State Police, and the U.S. Department of State’s Diplomatic Security Service.

Saleh was also ordered to pay a $1,000 fine as part of his sentence, handed down by U.S. District Court Judge Charles J. Siragusa.

The case is a reminder of the importance of honesty when applying for immigration benefits, and the consequences of making false statements.
