Defendant’s Tax Fraud Lands Him in Hot Water

In a shocking turn of events, Roger A. Armstrong, a 61-year-old certified public accountant from Vineyard Haven, Massachusetts, was sentenced to three years of probation for filing false tax returns. The scheme, which spanned three years, resulted in Armstrong underreporting a staggering $800,000 in income.

According to court documents, Armstrong, who owned rental property in Massachusetts and Florida, failed to report a total of $790,000 in gross receipts and $47,000 in rental income for tax years 2009 through 2011. This egregious underreporting led to Armstrong owing $200,000 in unpaid taxes.

Armstrong, a sole proprietor, was required to accurately report his business gross receipts and profit or loss on his individual income tax returns. However, he chose to engage in blatant tax evasion, leaving him to face the music in the courtroom.

On Tuesday, April 28, 2015, U.S. District Court Judge Indira Talwani handed down the sentence, which included three years of probation, the first nine months of which will be served in home confinement. Armstrong was also ordered to pay a fine of $3,000 and restitution of $389,365, which includes his taxes owed, as well as interest and penalties.

The case was prosecuted by Assistant U.S. Attorney Sandra S. Bower of U.S. Attorney Carmen M. Ortiz’s Economic Crimes Unit. William P. Offord, Special Agent in Charge of the Internal Revenue Service’s Criminal Investigation in Boston, made the announcement today.
