Aaron Sharpfish, a 21-year-old man from Rosebud, South Dakota, has pleaded guilty to Assault with a Dangerous Weapon, a federal crime that carries a maximum penalty of 10 years in custody, a $250,000 fine, or both.
According to court documents, the incident took place on November 21, 2011, when Sharpfish hit the victim, causing him to fall to the ground. Sharpfish then kicked the victim in the head and face several times, resulting in a fracture to the victim’s eye.
The investigation was conducted by the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Marie H. Ruettgers is prosecuting the case.
Sharpfish appeared before U.S. District Judge Roberto A. Lange on March 5, 2013, and entered his guilty plea. A presentence investigation has been ordered, and a sentencing date has been set for May 15, 2013. Sharpfish was remanded to the custody of the U.S. Marshal pending sentencing.
The maximum penalty for Assault with a Dangerous Weapon includes 10 years in custody, a $250,000 fine, or both, as well as 3 years of supervised release and a $100 special assessment.
Sharpfish’s guilty plea marks a significant development in the case, which has been ongoing since the incident in 2011. The Rosebud Sioux Tribe Law Enforcement Services is to be commended for their thorough investigation.
