Ryan Diefenbach, Felon in Possession of a Firearm, Massachusetts 2021

Hyannis Man Faces Up to 10 Years in Prison for Felon in Possession Charge

A Hyannis man is facing serious consequences after pleading guilty to being a felon in possession of a firearm. Ryan Diefenbach, 33, pleaded guilty to one count of being a felon in possession of a firearm before U.S. Senior District Judge William G. Young, who scheduled sentencing for Oct. 16, 2024.

The guilty plea stems from a 2021 incident in which Diefenbach and co-defendant Donnell Pina allegedly sold a Chinese SKS .762 caliber rifle to a confidential informant in Hyannis. Diefenbach’s possession of the firearm was a violation of his previous felony convictions, including carrying a firearm without a license, unlawfully possessing a firearm, possessing a firearm with a defaced serial number, and assault with a dangerous weapon.

At the time of the offense, the charge of being a felon in possession provided for a sentence of up to 10 years in prison, up to three years of supervised release, and a fine of up to $250,000. The case is part of Project Safe Neighborhoods (PSN), a program aimed at reducing gun violence and other violent crime in communities across the country.

Acting United States Attorney Joshua S. Levy and James M. Ferguson, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms & Explosives, Boston Field Division, made the announcement today. Assistant United States Attorney Elianna J. Nuzum of the Major Crimes Unit is prosecuting the case.

The indictment alleges that Diefenbach and Pina possessed the firearm in September 2021. The details contained in the indictment are allegations, and Pina is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.

Project Safe Neighborhoods is a program that brings together all levels of law enforcement and the communities they serve to reduce gun violence and other violent crime. The program is based on the core principles of fostering trust and legitimacy in communities, supporting community-based organizations, setting focused and strategic enforcement priorities, and measuring results.
