GREGORY McINTYRE, 19, of Sallisaw, Oklahoma, is headed behind bars for 13 months after pleading guilty to stealing firearms from a federally licensed dealer. The conviction, handed down in U.S. District Court in Muskogee, marks the end of a years-long investigation into the theft of weapons from Gems Gun & Pawn, a licensed firearms vendor operating under federal regulations.
The indictment, filed in the Eastern District of Oklahoma, charged McINTYRE with stealing multiple firearms from the dealership on or about August 29, 2015. Federal prosecutors confirmed that the stolen weapons had been shipped and transported in interstate commerce, triggering federal jurisdiction under Title 18, United States Code, Sections 924(m) and 2.
Authorities say the theft was uncovered through a joint probe by the Sallisaw Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Investigators moved quickly to trace the breach, identifying McINTYRE as the sole suspect in the burglary that targeted the pawn shop’s firearm inventory.
At sentencing, U.S. District Judge Ronald A. White presided over the hearing, delivering a no-parole sentence that will see McINTYRE locked up in a federal facility. He remains in custody of the U.S. Marshals Service pending transfer to the designated prison, where he’ll serve every month of the term.
Assistant United States Attorney Timothy Hammer, who prosecuted the case, emphasized the seriousness of stealing from a licensed dealer: “These aren’t just tools—they’re regulated weapons. When someone raids a federal dealer, they’re not just stealing guns. They’re violating a federal system built to keep firearms out of the wrong hands.”
The case underscores ongoing scrutiny of firearms security at licensed dealerships, especially in rural jurisdictions. For now, McINTYRE’s name joins the growing list of Oklahoma offenders charged under federal firearms statutes—one theft, one conviction, and 13 months to think about it.
