Sheldon Miner, Sex with Incapacitated Person, South Dakota 2014

A disturbing sex crime shook the small community of Eagle Butte, South Dakota, after an elderly man was sentenced for having sex with an incapacitated person.

Sheldon Miner, 62, also known as Salty Miner, was handed a 36-month prison sentence by U.S. District Judge Roberto A. Lange on June 16, 2014. In addition to his prison term, Miner was also ordered to serve five years of supervised release, pay a $100 special assessment to the Federal Crime Victims Fund, and register as a sex offender.

The incident occurred in October 2012 in Dewey County when Miner engaged in sexual contact with a victim who was asleep on a couch following a house party. The victim was physically incapable of declining participation in the sexual contact, and Miner was convicted of Sexual Contact with a Person Incapable of Consenting.

The investigation into Miner’s crime was a joint effort between the Federal Bureau of Investigation and the Cheyenne River Sioux Tribe Law Enforcement Division. Assistant U.S. Attorney Mikal Hanson prosecuted the case.

Miner was remanded to the custody of the U.S. Marshals Service to begin serving his sentence. The conviction and sentencing of this disturbing crime serve as a reminder of the importance of protecting vulnerable individuals from exploitation and abuse.

The people of Eagle Butte can breathe a sigh of relief now that justice has been served, but the community will never forget the pain and trauma inflicted upon the victim and their loved ones.

This case is a stark reminder that sex crimes can happen anywhere, and it’s up to us to create a safer and more just community for everyone.
