Colorado Businesswoman Pleads Guilty to Employment Tax Crimes
A devastating blow to the business world has been dealt in Colorado as Shandel Arkadie, a businesswoman from Agate, Colorado, pleaded guilty to not paying employment taxes.
According to documents and statements made in court, Arkadie operated a home health care business, Alternative Choice Home Care Nursing LLC. As the responsible party, Arkadie was tasked with withholding Social Security, Medicare and income taxes from Alternative Choice’s employees’ wages and paying those funds over to the IRS each quarter. Furthermore, she was also responsible for paying over Alternative Choice’s portion of Social Security and Medicare taxes. The heinous crime unfolded between January 2015 and December 2020, during which the company withheld over $1,000,000 from its employees’ wages but did not pay the funds over to the IRS or file the requisite quarterly tax returns. In addition, the company owed approximately $500,000 in Social Security and Medicare taxes, which Arkadie did not pay.
In total, Arkadie caused a tax loss to the IRS of about $1,500,000. This staggering amount has left many in the community reeling and questioning the motives behind Arkadie’s actions.
Arkadie is scheduled to be sentenced on May 15. She faces a maximum penalty of five years in prison, a period of supervised release, restitution and monetary penalties. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.
The case has been made possible by the tireless efforts of the IRS Criminal Investigation team, who have worked tirelessly to bring Arkadie to justice. Acting Deputy Assistant Attorney General Karen E. Kelly of the Tax Division made the announcement, highlighting the importance of upholding the law and ensuring that those who break it face the consequences.
For now, Arkadie remains a free woman, awaiting her fate on May 15. As the community waits with bated breath, one thing is certain: justice will be served, and Arkadie will face the music for her heinous crime.
