Shawndale James, Felon in Possession of a Firearm, Wisconsin 2023

MADISON, WI – Shawndale James, 26, of Madison, Wisconsin, is headed to federal prison for two years and two months after a .40 caliber handgun found under the seat he occupied linked him to an illegal weapon. Chief U.S. District Judge James D. Peterson delivered the sentence Thursday, adding three years of supervised release following James’ incarceration.

The case began on December 21, 2021, when Madison police pulled over the vehicle James was riding in. Officers spotted the loaded handgun, and James initially denied any knowledge of it. But forensic evidence told a different story. Swabs taken from the firearm revealed a DNA match to Shawndale James, directly contradicting his claims to police.

This wasn’t James’ first brush with the law. He already had prior felony convictions for driving a stolen vehicle and conspiracy to deliver heroin. Adding insult to injury, James was already out on bail in a separate state case – another charge of being a felon in possession of a firearm – when he was caught with this weapon. The pattern of disregard for the law was clear.

During sentencing, Judge Peterson didn’t mince words. He confronted James about his continued criminal behavior, stating he needed to choose between his family and the negative influences pulling him toward the streets. Peterson warned James that continued down this path would result in a significantly longer prison term. The judge’s comments underscored the seriousness of the charge and James’ repeated offenses.

The investigation was a joint effort between the Madison Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Assistant U.S. Attorney Corey Stephan handled the prosecution. The case falls under Project Safe Neighborhoods (PSN), a Department of Justice initiative aimed at reducing violent crime by coordinating federal and state law enforcement efforts to target illegal gun possession and related offenses.

James pleaded guilty on June 12, 2023, to the charge of being a felon in possession of a firearm. His 26-month sentence sends a message that illegally possessing firearms while already a convicted felon will not be tolerated in the Western District of Wisconsin.
