Smarter Kids Child Care, Discrimination Against Child with Autism, Georgia 2024

ATLANTA, GA – In a shocking case of alleged disability discrimination, Smarter Kids Child Care, a private daycare facility in Smyrna, Georgia, has been found guilty of denying a child with autism an opportunity to participate in its program.

According to a settlement agreement reached with the U.S. Attorney’s Office for the Northern District of Georgia, Smarter Kids Child Care will pay $7,000 in compensation to the complainant and $1,000 as a civil penalty. The facility will also adopt a non-discrimination policy and provide mandatory training for employees who consider requests for reasonable accommodations or make enrollment decisions.

"The full and equal enjoyment of goods, services, facilities, and privileges of any place of public accommodation is a fundamental right," said U.S. Attorney Ryan K. Buchanan. "Children with disabilities deserve equal opportunities to participate in daycare programs, and my office looks forward to working with Smarter Kids to ensure it meets this critical obligation."

Title III of the Americans with Disabilities Act prohibits discrimination on the basis of disability in places of public accommodation. Smarter Kids Child Care operates childcare facilities that fall under this category, making it a violation of the law to deny a child with a disability an opportunity to participate in the program.

As part of the settlement agreement, Smarter Kids Child Care will also provide reasonable accommodations to children with disabilities, ensuring that they have equal access to the daycare program.

The case is being handled by Assistant U.S. Attorney Rahul Garabadu and Senior Civil Investigator Tamara Jones. Those seeking further information can contact the U.S. Attorney’s Public Affairs Office at USAGAN.PressEmails@usdoj.gov or (404) 581-6016.
