South Bend Felon Gets 46 Months for Gun Possession

SOUTH BEND, IN – James E. Burch II, 38, of South Bend, Indiana, is headed to federal prison after a judge delivered a 46-month sentence for illegally possessing a firearm. The sentencing, handed down yesterday by United States District Court Judge Cristal C. Brisco, marks the culmination of a case highlighting the ongoing struggle against gun violence and repeat offenders.

According to court documents, Burch was caught red-handed in August 2024, seen and photographed brandishing a .357 caliber revolver at a South Bend residence. When South Bend Police Department officers arrived on scene, they recovered the weapon and took Burch into custody. The find wasn’t just about the gun itself; Burch’s extensive criminal history made possession of it a federal offense.

Burch isn’t a first-timer. He boasts a record of three prior felony convictions – any one of which automatically disqualifies him from legally owning a firearm. Despite this, he chose to arm himself, putting himself and the community at risk. Acting United States Attorney M. Scott Proctor’s office didn’t mince words in pursuing the case, making an example of Burch’s blatant disregard for the law.

The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) led the investigation, with crucial support from the South Bend Police Department. Assistant United States Attorney Joel Gabrielse skillfully prosecuted the case, building a solid argument that led to Burch’s guilty plea and subsequent sentencing. The investigation wasn’t just about one gun, it was about disrupting a pattern of criminal behavior.

This case wasn’t isolated. It fell under the umbrella of Project Safe Neighborhoods (PSN), a comprehensive initiative designed to reduce violent crime and gun violence across the nation. The Department of Justice relaunched a strengthened PSN program in 2021, focusing on community trust, violence prevention, strategic enforcement, and measurable results.

Following his 46-month prison term, Burch will face an additional two years of supervised release. Whether that will be enough to steer him away from a life of crime remains to be seen. For now, South Bend is a little safer with one more gun-toting felon off the streets.
