A federal court has brought an end to the operations of Atlanta-area financial planner T. Michael Haney, who was caught promoting a Form 1099-OID tax scheme to support false tax withholdings. The permanent bar on Haney comes after he consented to a civil injunction order signed by Judge Clarence Cooper of the U.S. District Court for the Northern District of Georgia.
The government complaint alleged that Haney advised his customers to prepare false IRS forms, such as Form 1099-OID, to request fraudulent refunds based on phony claims of large income tax withholding. According to the complaint, Haney’s customers have submitted fraudulent refund claims of more than $3.5 million.
Haney’s actions are part of a long list of tax scams that the IRS identifies as the “Dirty Dozen” tax scams that taxpayers are urged to avoid. The Justice Tax Division has obtained hundreds of injunctions to stop the promotion of tax fraud schemes and the preparation of fraudulent tax returns.
T. Michael Haney, the defendant in this case, will be required to provide the government with a list of all persons to whom he sold his “OID” program since January 1, 2007, and to provide them with a copy of the injunction order. This move aims to prevent further harm to potential victims of Haney’s scheme.
The case serves as a reminder of the importance of tax compliance and the severe consequences that come with promoting or participating in tax scams. The public is urged to report any suspicious tax-related activities to the authorities immediately.
Haney’s actions have left a trail of financial devastation, with his customers having submitted false claims totaling over $3.5 million. The court order brings an end to his promotion of the Form 1099-OID tax scheme, and his customers will now be provided with a copy of the injunction order.
With this move, the government aims to prevent further damage to the public and ensure that those involved in tax scams are held accountable for their actions. The case highlights the ongoing efforts of the authorities to combat tax-related crimes and protect the public from financial harm.
