Tally Colombe, Retaliation Against a Witness, South Dakota 2018
A federal indictment has been handed down against Tally Colombe, 43, of Fort Worth, Texas, for conspiring to retaliate against a witness in a previous fraud case. The alleged retaliatory conduct took place on the Crow Creek Sioux Tribe’s reservation between September 8, 2017, and September 12, 2017.
Colombe is currently serving a federal sentence of imprisonment in Texas, and she will make her appearance at a later date. The maximum penalty upon conviction is up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The indictment alleges that Colombe, along with Elnita Rank, 81, of Fort Thompson, South Dakota; Kristal Hawk, 57, of Fort Thompson; Ronda Hawk, 60, of Fort Thompson; Tiffany Monteau, 43, of Chamberlain, South Dakota; and Stefan Monteau, 26, of Fort Thompson, conspired to take action harmful against a certain individual, which interfered with the lawful employment and livelihood of this individual.
The alleged retaliatory conduct was taken with the intent to retaliate against this individual for providing to a law enforcement officer truthful information relating to the commission and possible commission of a federal offense, namely program fraud and wire fraud. The charge is merely an accusation and the defendants are presumed innocent until and unless proven guilty.
The investigation is being conducted by the Federal Bureau of Investigation and the U.S. Attorney’s Office. Assistant U.S. Attorney Ann Hoffman is prosecuting the case.
Colombe’s appearance will be rescheduled at a later date. The case is ongoing and will be updated as more information becomes available.
