James formally intervened in the lawsuit today, declaring she will defend the constitutionality of the shield law and prevent Texas from turning New York courts into an extension of its anti-abortion agenda.
“Texas has no authority in New York, and no power to impose its cruel abortion ban here,” James stated bluntly. “Our shield law exists to protect New Yorkers from out-of-state extremists, and New York will always stand strong as a safe haven for health care and freedom of choice. The origin of this mess? In December 2024, the Texas attorney general sued a New York doctor in Texas court for offering telehealth abortion services from her Ulster County clinic. A Texas judge handed down the $113,000 judgment. When the attorney general tried to enforce that judgment in New York, the Ulster County Supreme Court, citing the shield law, refused to cooperate. Now, the Texas AG is taking the fight to New York courts, hoping to dismantle the state’s protective legislation.
Attorney General James isn’t backing down. She has formally notified Ulster County Supreme Court Judge David Gandin of her intervention, invoking her authority to defend challenged New York laws. Her upcoming filing will argue that New York has both the legal right and responsibility to protect its residents, providers, and courts from this blatant overreach. This is more than just a legal skirmish; it’s a fight for state sovereignty.
