New York City Man Charged With Drug Trafficking Offense

A 31-year-old New York City man has been charged with drug trafficking in Pennsylvania, according to the United States Attorney’s Office for the Middle District of Pennsylvania.

Timothy Smart, a resident of New York City, has been accused of distributing cocaine hydrochloride, cocaine base (crack), and heroin in Luzerne and Lackawanna Counties on numerous occasions between 2012 and September 20, 2013.

The charges against Smart were filed in the United States District Court in Scranton yesterday, and a plea agreement has been filed in the case, subject to the approval of the Court.

United States Attorney Peter Smith noted that the charges are the result of an investigation by the Federal Bureau of Investigation and the Pennsylvania State Police into the sale of drugs at motels in Luzerne and Lackawanna Counties.

The prosecution is assigned to Assistant United States Attorney John Gurganus.

Smart is charged with a serious crime, and his actions have likely had a significant impact on the community. The maximum penalty under the federal statute is 20 years’ imprisonment, a term of supervised release following imprisonment, and a fine.
