Hotel Agrees to Settle ADA Allegations
NASHVILLE – In a shocking turn of events, Triumph Hospitality, LLC and A&S Hospitality Management, LLC, the owners and operators of the Garner Hotel in Clarksville, Tennessee, have agreed to settle allegations that the hotel violated the Americans with Disabilities Act (ADA) by failing to honor a reservation made for an accessible room by an individual with a disability.
According to the U.S. Attorney’s office, the Garner Hotel failed to honor a reservation made by a complainant with a disability, and hotel staff made insensitive and inappropriate comments regarding the complainant’s disability. The complainant was unable to use the shower in the room where they ultimately stayed.
The U.S. Attorney’s office alleges that the hotel failed to have systems in place to effectively manage reservations made for accessible rooms by individuals with disabilities, and that the hotel staff questioned the complainant’s disabled status while other individuals in the hotel’s lobby and the complainant’s family were present.
As part of the settlement, the Garner Hotel will implement an ADA policy that complies with the Code of Federal Regulations sections pertaining to hotels. The hotel will also conduct ADA training and pay the complainant $5,000.00 and a civil penalty to the United States of $2,000.00.
The civil claims settled by this Settlement Agreement are allegations only, and there has been no determination of liability.
Assistant U.S. Attorney Mike Tackeff investigated the complaint and negotiated the Settlement Agreement.
The U.S. Attorney’s office is committed to enforcing the rights of persons with disabilities in Tennessee. Hotels must have systems in place to effectively manage reservations made for accessible rooms by individuals with disabilities.
Tripium Hospitality, LLC and A&S Hospitality Management, LLC, will implement an ADA policy and conduct ADA training as part of the settlement. The complainant will receive $5,000.00 and the U.S. government will receive $2,000.00 in civil penalties.
The case highlights the importance of ADA compliance in hotels and the need for effective management of reservations made for accessible rooms by individuals with disabilities.
