Mesa, Arizona – TRW Vehicle Safety Systems, Inc. was sentenced following a guilty plea to federal and state charges stemming from the illegal disposal of hazardous waste, according to court documents unsealed this week. The automotive safety systems manufacturer knowingly shipped dangerous materials to an unpermitted landfill, exposing both human health and the environment to potential harm.
Prosecutors detailed a scheme spanning from 1995 to September 1996, during which TRW’s Mesa II facility improperly stored mixtures of commercial-grade pure sodium azide waste and water. Instead of adhering to proper hazardous waste disposal protocols, the company contracted with an Arizona transportation firm to haul at least 150 loads of the toxic substance to the Butterfield Station landfill in Mobile, Arizona. Crucially, TRW was fully aware that Butterfield Station lacked the necessary permits to receive Resource Conservation and Recovery Act (RCRA)-regulated hazardous waste.
Sodium azide, a highly toxic compound often used in automotive airbags, poses significant risks to human health, potentially causing respiratory distress, cardiovascular problems, and even death. Environmental contamination from sodium azide can also harm wildlife and pollute water sources. The deliberate circumvention of environmental regulations by TRW represents a serious breach of public trust and a reckless disregard for safety, investigators stated.
The case unfolded after an investigation by the Environmental Protection Agency (EPA) and the Arizona Department of Environmental Quality. On January 18, 2001, TRW was formally charged with ten counts of violating 42 U.S.C. §6928(d)(2)(A), which prohibits the knowing treatment, storage, or disposal of hazardous waste in an unlawful manner. The company entered a guilty plea to all counts.
Penalties and Sentencing
On August 20, 2001, the court imposed a sentence of sixty months probation on TRW Vehicle Safety Systems. In addition to probation, the company was ordered to pay a $4,000 special assessment fee. The financial penalties totaled $12 million, comprised of a $6 million federal fine and a matching $6 million in state fines. These substantial fines are intended to deter future violations and fund environmental remediation efforts.
