Jesus Javier Malagon, 32, of Twin Falls, is headed to federal prison for nearly 30 years after opening fire on a Shoshone City police officer during a violent crash aftermath, triggering a firefight that left him shot and bleeding but alive. A Boise jury convicted Malagon in February after a weeklong trial on federal drug and firearm charges, culminating in a 355-month sentence handed down yesterday by U.S. District Judge B. Lynn Winmill.
The violence traces back to January 30, 2018, when Malagon was pulled over by a Shoshone officer during a routine traffic stop. Inside his vehicle, authorities found a loaded 9-millimeter handgun, a .38-caliber revolver, multiple pounds of marijuana, a digital scale, and drug packaging materials—clear indicators of ongoing distribution. Instead of complying, Malagon slammed the gas and fled at high speed, leading to a chaotic pursuit that ended when he lost control and crashed.
Dazed and injured from the collision, Malagon didn’t surrender. As the officer approached, he drew the 9-millimeter and opened fire. The officer, unharmed, returned fire immediately, striking Malagon multiple times. Though seriously wounded, Malagon survived his injuries, which were deemed non-life threatening. A post-crash search of the wreckage uncovered the weapons, drugs, and further evidence linking him to a sustained drug trafficking operation.
Federal prosecutors emphasized that Malagon was a convicted felon—previously found guilty of manufacturing marijuana—making his possession of any firearm a federal crime. His criminal history, combined with the attempted attack on a law enforcement officer, triggered enhanced sentencing under federal guidelines. In addition to the 355-month prison term, he will serve four years under court supervision upon release.
The investigation was a multi-agency effort led by the Bureau of Alcohol, Tobacco, Firearms and Explosives, Shoshone City Police Department, and Gooding County Sheriff’s Office. The Critical Incident Task Force—comprised of Idaho State Police, Twin Falls County Sheriff’s Office, and Twin Falls City Police—also played a key role in reconstructing the shooting and building the case against Malagon.
This prosecution was carried out under the Department of Justice’s Project Safe Neighborhoods (PSN) initiative, a nationwide strategy targeting violent offenders to reduce crime through coordinated enforcement. U.S. Attorney Bart M. Davis stated the sentence sends a clear message: those who arm themselves illegally and attack police will face the full weight of federal justice.
