LAREDO, Texas – A brazen attempt to evade authorities ended with a 15-month federal prison sentence for Marco Cupil-Hernandez, a 21-year-old Mexican citizen. The sentence, handed down by U.S. District Judge John A. Kazen, stems from a violent assault on a Border Patrol agent earlier this year. Cupil-Hernandez, hailing from Nuevo Laredo, Tamaulipas, Mexico, pleaded guilty April 28th to assaulting a federal agent and inflicting bodily injury.
The incident unfolded January 23rd after Cupil-Hernandez illegally entered the United States by wading across the Rio Grande. Immediately taken into custody, he feigned injury, prompting officers to transport him to a local hospital for evaluation. While ostensibly receiving medical attention, Cupil-Hernandez was anything but compliant. After being cleared for release – despite walking with a noticeable limp – he launched a calculated attack when the agent attempted to assist him into a vehicle.
What began as a forceful shove quickly escalated into a desperate and undignified struggle. As the agent attempted to restrain Cupil-Hernandez, the suspect actively worked to disrobe, shedding articles of clothing each time the agent gained purchase. The situation devolved into a chaotic scene, culminating in Cupil-Hernandez elbowing the agent in the face, breaking his grip and fleeing the scene – clad only in his underwear and shoes.
The agent sustained injuries to his knee and back during the struggle, Judge Kazen noted, dismissing Cupil-Hernandez’s claim that he simply wanted to escape and had no intention of causing harm. The judge determined the suspect’s actions indicated a planned fight, not a panicked flight. Authorities apprehended Cupil-Hernandez a short time later, discovering him attempting to hide under the covered parking spaces of a nearby gym.
Cupil-Hernandez, who is not a U.S. citizen, will now begin serving his 15-month sentence and is expected to face removal proceedings upon completion. The FBI led the investigation, with crucial assistance from Border Patrol and Customs and Border Protection Air and Marine Operations. Assistant U.S. Attorney Homero Ramirez prosecuted the case. This case is part of Operation Take Back America, a nationwide initiative aimed at combating illegal immigration and transnational crime.
Operation Take Back America, according to the Department of Justice, streamlines resources from the Organized Crime Drug Enforcement Task Forces and Project Safe Neighborhoods, focusing on repelling illegal immigration, dismantling cartels, and protecting communities. The Department of Justice has made it clear that assaults on federal agents will not be tolerated, and perpetrators will face the full weight of the law. Cupil-Hernandez will remain in custody pending transfer to a yet-to-be-determined Federal Bureau of Prisons facility.
