A Rosebud, South Dakota, woman has been indicted on federal charges of Assault With a Dangerous Weapon and Child Abuse after allegedly kicking a child repeatedly while wearing cowboy boots. Victoria Smashed Ice, 26, was named in a grand jury indictment returned on May 14, 2019, accusing her of violent acts against a minor with the intent to cause bodily harm.
According to the indictment, on or about April 1, 2019, Smashed Ice assaulted the child using her shod feet as weapons, delivering repeated kicks that constituted torture, torment, and cruel punishment. The charges detail a brutal incident in which the defendant allegedly abused, exposed, and tortured the child on the Rosebud Indian Reservation, escalating the case to federal jurisdiction.
Smashed Ice appeared before U.S. Magistrate Judge Mark A. Moreno on May 17, 2019, where she entered a plea of not guilty. She was subsequently remanded into the custody of the U.S. Marshals Service, where she remains pending trial. No trial date has been set.
If convicted, Smashed Ice faces a maximum penalty of up to life in federal prison and/or a $250,000 fine. Additional penalties include 3 years to life of supervised release, a $100 special assessment to the Federal Crime Victims Fund, and possible court-ordered restitution.
The investigation was conducted by the Federal Bureau of Investigation, highlighting the seriousness of the allegations and the federal response to violent crimes on tribal lands. Assistant U.S. Attorney Michael J. Elmore is prosecuting the case on behalf of the United States.
