Marcobrien S. Volcy, 28, of Rochester, NY, has pleaded guilty to possession of child pornography, a charge that carries a mandatory minimum penalty of 10 years in prison, a maximum of 20 years, and a fine of $250,000.
According to U.S. Attorney Michael DiGiacomo, Volcy pleaded guilty before Chief U.S. District Judge Elizabeth A. Wolford to the charges, which stem from an investigation by the Federal Bureau of Investigation, under the direction of Acting Special Agent-in-Charge Mark Grimm.
Assistant U.S. Attorney Katelyn M. Hartford, who is handling the case, stated that in August 2023, Volcy pleaded guilty in Monroe County Court to Possessing a Sexual Performance by a Child Less Than 16 Years of Age and was sentenced to one to three years in prison. However, on January 19, 2024, while on New York State probation for his 2023 conviction, Volcy was found to be in possession of a cell phone that contained images and videos of child pornography.
In total, Volcy possessed more than 650 images and videos of child pornography, some of which depicted prepubescent children. This is a shocking and disturbing case, and the fact that Volcy was able to access and possess such material while on probation is a clear indication of the need for stricter monitoring and enforcement of those convicted of such crimes.
The guilty plea is a result of the investigation by the FBI, and sentencing is scheduled for January 14, 2026, before Judge Wolford. It is expected that Volcy will receive a significant sentence, given the severity of the charges and the fact that this is not his first offense.
This case highlights the ongoing problem of child pornography in our society, and the need for law enforcement to continue to work tirelessly to identify and prosecute those who engage in such heinous crimes. The fact that Volcy was able to plead guilty to such charges while already on probation for a similar offense is a clear indication that more needs to be done to prevent such crimes from occurring in the first place.
